We were instructed by a client in relation to a claim against an Emergency Department in a Dublin Hospital. Our client attended with an out of hours GP in April with pain in her side. She was advised to attend the Emergency Department if the pain persisted. Our client attended the hospital the following day and was discharged with an incorrect diagnosis of constipation.

Our client was taken by ambulance to the same Emergency Department in October. A CT scan was carried out which resulted in a provisional diagnosis of ovarian torsion. For this reason, our client was transferred by ambulance to a Maternity Hospital in Dublin. Our client underwent a laparoscopy which showed a large left ovarian cyst that was twisted and gangrenous. As a result, the laparoscopy was converted to an open surgical procedure and an ovary and fallopian tube were removed.

We issued High Court proceedings on behalf of our client. The case was listed for hearing but settled prior to the hearing date.
