How can a Fatal Injury Claim arise?

Fatal injury claims can be made for accidents in public or workplaces. In Ireland, claims are accepted for fatal injuries due to:

What can you be compensated for?

The family of a deceased person has two years to file a fatal injury claim. After two years, the validity of the claim may be in question. You can receive compensation for:

  • Financial loss: You can file a fatal injury claim if you are financially dependent on the deceased. This can include the loss of service provided by the deceased. This includes child care, home repairs, and other services. An actuary is appointed to assess the financial compensation you are eligible for.
  • Mental distress: You can file a claim for mental distress that follows the death of a loved one. The Irish Government has placed a maximum amount on the compensation received under this type of claim. You may be eligible for €35,000 for the mental stress you have suffered after the fatal injury. This claim is independent of the number of dependents of the deceased.
  • Funeral costs: You can file a claim to be compensated for the funeral expenses incurred after the fatal injury. This type of claim covers the charges of all last rites and rituals you may require including church service, travelling expenses, etc.

What is the process of filing a claim?

  1. Seeking medical attention: If you have been involved in the accident, you will first need to call for medical assistance. The medical personnel will also confirm the time and cause of death.
  2. Informing the Gardai: An official report of the accident will have to be generated with the Gardai. If you are aware of any witnesses to the accident, you can inform the Gardai so they can follow up with the same.
  3. Starting your claim: The fatal accident claim solicitor will help you compile a valid claim for the accident and submit it to the Board. The Board will assess the validity of your claim and ensure all documents are in order so that you will not face any hassle.
