The Garda Compensation Scheme is designed to compensate members of An Garda Síochána who have been maliciously injured while performing their duties, operating in their general capacity as a member while off duty, or simply because they are members of An Garda Síochána. The scheme is also open to the dependants of deceased members who have been fatally injured while on duty or while acting in their general capacity as a member or merely because of their being a member of An Garda Síochána.

What you need for Garda Compensation Claims

You

Your application form should be submitted by registered post and include the Garda’s name, address, rank, Garda number, and a description of the injuries sustained in the incident.

Who

This section deals with the beneficiary of the claim, which can be two groups of individuals:

  • Members of An Garda Siochana who are subjected to maliciously inflicted personal injuries (that do not result in death)
  • Dependents of deceased members who died while on service, operating in their general capacity as a member, or simply because they were a member of An Garda Síochána. It includes the deceased person’s widow, children, stepchildren, parents, siblings, half brothers or sisters, grandparents, or adopted children under the age of 21 who were sponsored, sustained, and educated by the deceased person.
When

You must submit your application for compensation within three months of the date the incident occurred. It is possible to get this time extended through the Minister for Justice and Equality. However this is very difficult to get approved which is why it is vital you make sure the application form is submitted as soon as possible.

How is the compensation evaluated?

The compensation amount will heavily depend on the nature of the individual case, the type of the initial injury you were subject to, the time it takes to recover if that is a possible outcome, any expenses covered personally by you both since the date of the initial injury or into the future and any other losses including the potential future loss of earnings.

There are currently proposal to amend the Garda Compensation Scheme process. The Garda Síochána (Compensation) Bill 2021 will bring the process with the remit of the Personal Injuries Assessment Board (PIAB) which will speed up the process.
